Terms of Use

Effective 2026-10-13 · Prosper Insurance Solutions

The short version: this site helps you request an insurance quote from a licensed agent. A quote isn't a policy, coverage starts only when a policy is issued, and any dispute goes to individual arbitration unless you opt out (see section 12).

1. Accepting these terms

By using this website or submitting our quote form, you agree to these Terms of Use and our Privacy Policy. If you don't agree, please don't use the site; you can call us at (858) 581-2131 instead.

2. About us

Prosper Insurance Solutions is an insurance agency licensed in California. Nothing on this site is an offer to sell insurance in a state where we aren't licensed. Using this site doesn't bind coverage and doesn't create an agent-client relationship until we confirm one.

3. Quotes are estimates

Quotes are estimates based on the information you provide and on insurer rules that can change. Your final price, eligibility, and coverage depend on underwriting, verification (such as driving, claims, and property records), and the terms of the policy actually issued. Discounts vary and are not available in all situations.

4. Website content

Content on this site is general information, not legal, tax, or financial advice, and doesn't change the terms of any policy. Policy documents control.

5. Your submissions

You agree that the information you submit is true and is your own (or that you're authorized to submit it). Inaccurate information can change your quote or affect coverage.

7. E-SIGN consent

Under the federal E-SIGN Act, you agree that clicking the submit button on our form is your electronic signature, with the same effect as a handwritten signature, and that we may give you records and disclosures electronically. You can ask for a paper copy at no charge, or withdraw this consent, by contacting us. You need a device with a web browser and an email account to receive electronic records.

8. Acceptable use

Don't submit false information or someone else's details without permission, interfere with the site, scrape it with automated tools, or use it for any unlawful purpose.

9. Intellectual property

The site's design, text, and graphics belong to Prosper Insurance Solutions or its licensors. Insurance company names and logos are trademarks of their owners and are used only to identify those companies.

10. Third-party sites

Links to other websites are provided for convenience. We aren't responsible for their content or practices.

11. Disclaimers and limitation of liability

The site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim implied warranties, and our total liability for any claim related to the site is limited to $100. These limits don't affect any rights you have under an insurance policy, under insurance laws, or under any other law (including statutory damages) that can't be waived or limited by contract.

12. Dispute resolution and arbitration

Informal resolution first. Before filing a claim, you and we agree to try to resolve it informally for 30 days after one side sends written notice describing the dispute. Statutes of limitation and filing deadlines are tolled during this 30-day period.

Binding individual arbitration. If it isn't resolved, any dispute about this site, your quote request, or calls and texts from us will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. We'll pay all AAA filing, administration, and arbitrator fees for consumer claims, except as the AAA rules require you to pay. The arbitration will take place in San Diego County, California, or by phone or video if you prefer.

Class and jury waiver. You and we each waive the right to a jury trial and to bring or join a class or representative action. Claims may only be brought individually.

Mass Arbitration. If 25 or more similar arbitration demands are filed by or with the help of the same law firm or organization, they will be administered in batches under the AAA's Mass Arbitration supplementary rules, and both sides agree to cooperate in good faith to resolve them efficiently.

Exceptions. Either side may bring an individual claim in small claims court. Nothing here stops you from filing a complaint with, or seeking relief through, a government agency, including your state insurance department, the Federal Communications Commission, the Federal Trade Commission, or your state attorney general.

Opt out. You can opt out of this arbitration agreement within 30 days after you first agree to these terms by emailing todd@getprosperins.com or mailing Prosper Insurance Solutions, 7710 Balboa Ave, Suite 323, San Diego, CA 92111, with your name, phone number, and a statement that you opt out of arbitration.

Changes. If we change this section, the change won't apply to a dispute that arose, or that you told us about, before the change took effect.

13. Governing law

These terms are governed by the laws of the State of California and applicable federal law, including the Federal Arbitration Act. Any court proceeding allowed under these terms will be brought in the state or federal courts located in San Diego County, California.

14. Accessibility

We want this site to be usable by everyone. If you have trouble using it, call (858) 581-2131 and we'll take your quote request by phone and work to fix the problem.

15. General

If any part of these terms is unenforceable, the rest stays in effect. We may update these terms; the effective date shows when they last changed. Questions? Contact Prosper Insurance Solutions at (858) 581-2131 or todd@getprosperins.com.
